Look, I'll be honest with you. All the legal text below exists because some people in suits decided we need walls of text to do business on the internet. People who, in my humble opinion, have clearly lost their connection to the real world and real life. I find most of it as exciting to read as assembly instructions for flat-pack furniture.
Here's what actually matters to me: if you ever have a problem, concern, or just want to clarify something, please reach out directly. I'm a real person, not a corporation. I built this tool because I believe indie creators deserve better marketing tools, and I'd much rather have a human conversation than hide behind legal jargon.

1. Introduction
Welcome to SellMyShit ("Service"), a marketing automation platform for indie developers and digital product creators, operated at sellmyshit.asv.pt. By using our Service, you agree to these Terms and Conditions ("Terms"). Please read them carefully.
The Service is operated by Marc Mennigmann, Pedra Branca Caixa Postal 310-M, 8600-253 Odiaxere, Portugal (NIF: 284317098). See our Imprint for full contact details.
2. Account Registration
- You must be at least 18 years old to use this Service
- You must provide accurate and complete registration information
- You are responsible for maintaining the security of your account credentials
- You are responsible for all activities that occur under your account
- One person or entity may only maintain one free account
3. Subscription Plans and Pricing
Available Plans
- Free: 1 product, content generation only, 1 press release, 1 newsletter, no posting
- Basic (€15/month): 1 product, 1 social set, 200 posts per billing cycle
- Pro (€29/month): 3 products, 2 social sets, 600 posts per billing cycle
- Business (€75/month): 10 products, 5 social sets, 2000 posts per billing cycle
Annual subscriptions receive 2 months free (pay for 10 months, get 12). All prices include applicable VAT.
Add-on Purchases
Additional post packs (+1000 posts for €15) can be purchased at any time. Add-on posts never expire and are consumed only after your monthly allowance is exhausted.
Billing Cycle
Post allowances reset on your billing anniversary (the day you subscribed), not on calendar months.
4. Upgrades and Downgrades
Upgrades
Plan upgrades take effect immediately. You will be charged a prorated amount for the remainder of your current billing cycle.
Downgrades
Plan downgrades take effect at the end of your current billing period. Before downgrading, you must ensure your usage is within the new plan's limits:
- Delete products if you exceed the new plan's product limit
- Disconnect social accounts if you exceed the new plan's social set limit
Downgrade requests will be blocked until you are within the new plan's limits.
5. Right of Withdrawal (EU Consumers)
Withdrawal Right
As an EU consumer, you have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days from the day of the conclusion of the contract.
How to Exercise Your Right
To exercise your right of withdrawal, you must inform us of your decision by email to info@asv.pt with a clear statement (e.g., "I hereby withdraw from my contract for SellMyShit subscription").
Effects of Withdrawal
If you withdraw, we shall reimburse all payments received from you without undue delay and no later than 14 days from the day we are informed of your withdrawal decision. We will use the same means of payment you used for the initial transaction.
Exception for Digital Content
By using the Service and generating or publishing content, you expressly consent to the immediate performance of the contract and acknowledge that you lose your right of withdrawal once the service has been fully performed (i.e., content has been generated or posts have been published on your behalf).
6. Refund Policy
In addition to the statutory right of withdrawal above, we offer the following voluntary refund policy:
Monthly Subscriptions
Full refund available within 14 days of purchase if fewer than 20 posts have been published. After 14 days, you may cancel anytime and retain access until the end of your billing period.
Annual Subscriptions
Full refund available within 14 days of purchase if fewer than 50 posts have been published. Annual subscriptions cannot be partially refunded after 14 days - you may cancel anytime and retain access until the end of your annual period.
Add-on Post Packs
Add-on purchases are non-refundable once purchased, as they represent digital content delivered immediately.
7. Cancellation
You may cancel your subscription at any time. Upon cancellation:
- You retain full access until the end of your current billing period
- Your account will revert to the Free plan when the period ends
- Unused monthly posts do not roll over or convert to add-on balance
- Add-on post balance is retained but cannot be used on the Free plan
8. Payment Failures
If a payment fails, you have a 7-day grace period to update your payment method. During this time, you retain full access. After 7 days, your account will be downgraded to the Free plan.
9. Service Description
SellMyShit provides:
- AI-powered marketing content generation for your products
- Social media post scheduling and publishing
- Press release and newsletter generation
- Content management and analytics
10. AI-Generated Content
Content Generation
Content is generated using artificial intelligence (Claude by Anthropic) based on the product information you provide. AI-generated content is provided as a draft and a starting point only. It is not reviewed, verified, or approved by SellMyShit before being made available to you.
Your Responsibility
You are solely responsible for reviewing, editing, and approving all AI-generated content before it is published. This includes but is not limited to:
- Verifying the accuracy of all factual claims, product descriptions, and statements
- Ensuring content complies with applicable laws and regulations (including advertising standards, consumer protection laws, and intellectual property rights)
- Ensuring content complies with the terms of service of each social media platform
- Checking that content is appropriate for your audience and brand
- Reviewing content for potential defamation, misleading claims, or offensive material
No Guarantee of Accuracy
AI-generated content may contain inaccuracies, errors, misleading statements, or inappropriate material. We do not guarantee the accuracy, completeness, appropriateness, legal compliance, or effectiveness of any AI-generated content. The AI may produce content that is factually incorrect, culturally insensitive, or otherwise unsuitable for publication.
Liability
SellMyShit shall not be held liable for any damages, losses, claims, or consequences arising from AI-generated content that you publish, whether or not you have reviewed or modified it. This includes but is not limited to damages arising from inaccurate claims, intellectual property infringement, regulatory violations, reputational harm, or any third-party claims related to published content. By using the content generation and publishing features, you accept full responsibility for all content published through your account.
Ownership and Data Use
- You retain ownership of your product information and the content generated for you
- We may use anonymized, aggregated usage data to improve our service
11. Social Media Connections
- You authorize us to post content to your connected social media accounts
- You are responsible for compliance with each platform's terms of service
- We are not responsible for actions taken by social media platforms (account suspension, post removal, etc.)
- You may disconnect social accounts at any time
12. Acceptable Use
You agree NOT to use SellMyShit to:
- Generate or distribute illegal, harmful, or offensive content
- Spam or engage in deceptive marketing practices
- Violate intellectual property rights of others
- Impersonate other individuals or entities
- Circumvent usage limits or abuse the Service
- Share account credentials with others
- Use automated tools to access the Service (except our official API, if provided)
13. Intellectual Property
Your Content
You retain all rights to your product information, uploaded media, and the content generated for you.
Our Service
SellMyShit, its features, design, and underlying technology remain our intellectual property. You may not copy, modify, or reverse engineer any part of the Service.
14. Limitation of Liability
To the maximum extent permitted by applicable law:
- The Service is provided "as is" without warranties of any kind
- We are not liable for any indirect, incidental, or consequential damages
- Our total liability is limited to the amount you paid us in the 12 months preceding the claim
- We are not responsible for losses due to social media platform changes, outages, or policy enforcement
Note: This limitation does not affect your statutory rights as a consumer under EU law, including rights related to non-conformity of digital content or services.
15. Service Availability
We strive for high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or experience outages. We will attempt to notify users of planned maintenance in advance.
16. Termination
We may suspend or terminate your account if you:
- Violate these Terms
- Engage in abusive or fraudulent behavior
- Fail to pay for your subscription after the grace period
You may terminate your account at any time by contacting us at info@asv.pt or using the account deletion feature.
17. Changes to Terms
We may update these Terms. For material changes, we will notify you via email or in-app notification at least 14 days before the changes take effect. Continued use of the Service after changes constitutes acceptance. If you do not agree to the new Terms, you may terminate your account.
18. Consumer Rights
Nothing in these Terms affects your statutory rights as a consumer under applicable EU and Portuguese law. Where any provision of these Terms conflicts with mandatory consumer protection laws, those laws shall prevail.
19. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court, the remaining provisions shall continue to be valid and enforceable. The invalid provision shall be replaced with a valid provision that achieves the original intent as closely as possible.
20. Entire Agreement
These Terms, together with our Privacy Policy and Imprint, constitute the entire agreement between you and us regarding the use of the Service.
21. Governing Law and Jurisdiction
These Terms are governed by the laws of Portugal. For consumers residing in the EU, you may bring proceedings in the courts of your country of residence. For all other users, any disputes will be resolved in the courts of Portugal.
